Linguaspectrum PLUS never shares any information about visitors with anyone, ever! Your email address is used only to allow our system to send you necessary information about your lessons, your results and any other things you need to know to get the best out of this site. From time to time we may send you information about new lessons, new teachers and new developments that we feel will interest you. You can easily choose not to receive these message by clicking the links in any email you receive.

We occasionally use third-party advertising companies to serve ads when you visit this website. These companies may use information (not including your name, address, email address or telephone number) about your visits to this and other websites in order to provide advertisements about goods and services of interest to you. If you would like more information about this practice and would like to know your options in relation to not having this information used by these companies, click here.

Cookies

Cookies are small files that the pages of some sites, like ours, need to work correctly. Site operators governed by European law are required to tell users that cookies are being used.

At Linguaspectrum PLUS, users who need the cookies are students and teachers. Under the exemptions provided in the relevant legislation, the cookies that our system use do not require us to obtain your consent as, "such storage or access is strictly necessary for the provision of an information society service requested by the subscriber or user."

You can block cookies using your browser settings, but you will find that the pages you want to use will no longer work.

Cancellation Policy

Cancellations apply to students who pay for Private Online Classes or Self-Study Courses through Linguaspectrum PLUS.

Cancellation of booked classes

You can cancel a booked class by using the automatic cancellation feature of the booking calendar. This is available to you as soon as you book your classes and full instructions are provided.

You must cancel any booked class at least 24 hours before the start time (Teacher Time). If you do not give at least 24 hours' notice of cancellation of a booked class, it will be deemed a missed class and the minutes booked will be deducted from your account as if you had taken the class.

If you give more than 24 hours' notice, the minutes booked will not be lost and you are free to use them when you wish.

Missed Classes

If you miss a class for any reason, without notifying your teacher 24 hours' in advance, you will lose the minutes that would have been used if you had taken the class.

Transfer of Class Time

For technical reasons, class time you have bought is not transferable and can only be used by the student to whose account the minutes were added.

Introductory Classes

An Introductory Class time and date must be agreed between the teacher and the student before the class. This will be confirmed by email.

Students must make every effort to attend the Introductory Class at the agreed time and date. If a student fails to take the class at the agreed time and date, another date may be offered. The student must agree to this second offer of a class time and date. This will be confirmed by email.

Students must make every effort to attend the Introductory Class at the second agreed time and date. If a student fails to take the Introductory Class at the second agreed time and date, no further class times or dates will be offered. No refunds will be given.

However, depending on the circumstances, your teacher may, at their discretion, reschedule the Introductory Class a second time.

Class Start Time

Classes start promptly at the time booked. Classes last for as long as the student has requested, up to a maximum of 2 hours - 120 minutes. If you attend class late, the class will nevertheless have begun from the booked time.

If you are more than 15 minutes late for the class, the class will not be started and will be classed as missed.

Refund Policy

Applies to all paid services provided by Linguaspectrum PLUS.

Introductory Class - the nominal fee charged for the Introductory Class is non-refundable once the time and date of the arranged class has passed. The arranged class time is the time and date agreed between the student and teacher by email.

Minutes - If you are not completely satisfied with the classes, you can have a refund for any remaining minutes bought within 14 days of purchase. After 14 days have passed since you bought them, no refund will be given. Any refund will be of remaining minutes less payment processing fees.

Linguaspectrum PLUS management reserve the right to refund money paid by a student if they consider it unlikely that the minutes bought with a particular teacher will be delivered by the said teacher for any reason whatever. The management's decision is final and binding.

Self-Study Courses - fees paid are non-refundable once the course has been accessed.

Technical Failure

You are responsible for ensuring that you have a fast enough Internet connection, working headphones or speakers, and a working microphone at the time of your booked class. A webcam is optional.

If you cannot take your class because of problems with your equipment or Internet connection, the class will be classed as missed and all booked minutes will be deducted from your account.

If your teacher is unable to give your class at the booked time for any reason beyond their control, you can use the minutes to book a new class at a time and date to suit you. However, no refunds will be given.

How Long are Your Bought Minutes Valid For?

Any minutes you have bought after Thursday 7th February 2013 are valid for 120 days from the date of purchase.

When buying minutes, decide how many classes you would to take each month and buy an appropriate number of minutes. It will also help your teacher to plan your classes better if you book them on your teacher's booking calendar well in advance.

Minutes are not transferable between different student accounts.

Terms and Conditions

The following are terms of a legal agreement between you and me, Richard Chalmers (Hereafter referred to as "me" or "I"), the owner of Linguaspectrum PLUS. By accessing or using the LinguaspectrumPLUS.com website (Hereafter referred to as my site), you acknowledge that you have read, understood, and agree to be bound by these terms and to comply with all applicable laws and regulations. If you do not agree to these terms, please do not use my site.

I may, without notice to you, at any time revise these Terms of Use and any other information contained in my site by updating this posting. I may also make improvements or changes in anything provided or described in my site at any time without notice.

Teacher Agreement

Linguaspectrum PLUS provides teachers with an online teaching platform designed to enable teachers who lack the skills or desire to create a complex website and online teaching presence to do so easily and quickly.

Linguaspectrum PLUS is NOT an employment service and all teachers using the services offered on the site do so as freelance teachers. No employment contract has been entered into or implied by your being granted the use of the services offered.

All payments from students for Teacher Minutes will be paid to Linguaspectrum PLUS and processed by PayPal on behalf of Linguaspectrum PLUS. Earnings will be held for a period of 14 days from the date of payment to make sure that any complaints or disputes that may arise can be successfully dealt with. When the balance of payments received more than 14 days beforehand, less PayPal charges incurred by Linguaspectrum PLUS and less 10% of the gross payment, exceeds the teacher's payment threshold, the money will be transferred to the teacher from PayPal to an acceptable destination of the teacher's choosing.

The receiving party is responsible for any charges incurred in receipt of the payment.

All classes must be booked with teachers by students using the booking form provided in the Student Lounge. Under no circumstance must students book classes direct with the teacher. There are many features built into the system designed to protect both the student and the teacher. These features make sure that minutes bought and used are accurately recorded. They provide protection for the teacher for missed and cancelled classes. They ensure that students accept the terms and conditions of the site and are thus legally bound by them. They alert us to possible problems. Without the accurate recording of class time given and minutes bought, discrepancies will arise that may prevent us paying teachers the money they are owed when they request it.

Any teacher found to have dealt directly with students that they have secured through their participation in Linguaspectrum PLUS in order to deprive Linguaspectrum PLUS of income will have their account suspended with immediate effect.

Teachers are not employees of Linguaspectrum PLUS and are responsible for their own tax payments on earnings in compliance with the appropriate legislation in their country of residence. Linguaspectrum PLUS will in no way be liable for any taxes or other payments for individual teachers. Teachers are only using our services to facilitate their own freelance teaching practice.

Linguaspectrum PLUS provides an online teaching platform for teachers. This platform is designed to give the teacher a means to post their biography, information about their teaching, and their availability through a booking calendar to prospective students. Linguaspectrum PLUS makes no guarantees, implied or otherwise, that teachers will secure paying students through the use of our service.

As a Linguaspectrum PLUS teacher, you agree to treat students, prospective students, fellow teachers and Linguaspectrum PLUS staff with respect and you further agree to maintain the high standards on which Linguaspectrum PLUS has been founded. You agree to be on time for all booked classes and agree to communicate promptly and courteously with all of your students.

You must describe yourself truthfully in your online biography and in all communication with Linguaspectrum PLUS.

Any teacher found to have been dishonest or to have engaged in any activity which does, or would be considered to be likely to do, damage to the reputation of the Linguaspectrum PLUS community of teachers may be removed from the site and all outstanding payments returned to their students.

You also agree not to post any copyrighted materials, when the copyright does not belong to you, to this site and agree not to encourage any user of this site to use copyrighted materials beyond the limits of the copyright.

You, and you alone, are responsible for anything you publish on Linguaspectrum PLUS and you grant Linguaspectrum PLUS the right to edit or remove any information you post.

You are responsible for keeping yourself available for Introductory Class requests from students. You must log into the site at least once every 7 days and should update your teacher profile information at regular intervals. If you have not logged in to the site for 7 days or more, students will no longer be able to book Introductory Classes with you. If you have not logged into the site for a period exceeding 30 days you will be deemed to have no further use for this platform and your account will be put on hold pending appeal. Your on hold account will no longer be usable for teaching purposes unless you can provide a valid reason for reinstatement of your account. We are under no obligation to email you regarding putting your account on hold. The first you will hear of it is an account on hold notice on your account when you log in. The decisions of the Linguaspectrum PLUS Management Committee is final and binding.

Your use of Linguaspectrum PLUS is entirely at your own risk. NEITHER Linguaspectrum PLUS, NOR ANY OF ITS SUBSIDIARIES, DIVISIONS, AFFILIATES, AGENTS, REPRESENTATIVES OR LICENSORS SHALL BE LIABLE TO YOU OR ANYONE ELSE FOR ANY LOSS OR INJURY OR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE OR SIMILAR DAMAGES ARISING OUT OF YOUR ACCESS OR USE OF, OR YOUR INABILITY TO ACCESS OR USE, THE SERVICE AND THE SITES AND THE INFORMATION AVAILABLE ON THE SERVICE AND THE SITES OR ARISING OUT OF ANY ACTION TAKEN IN RESPONSE TO OR AS A RESULT OF ANY INFORMATION AVAILABLE ON THE SERVICE AND THE SITES. In addition to this Teacher Agreement, all teachers using the services of Linguaspectrum PLUS are also bound by the site's general terms and conditions which can be found on the About Us page on the site.

Linguaspectrum PLUS promises to keep this site online 24 hours a day, 365 days a year, subject to the promise of our hosting service, HostGator, to guarantee 99.9% uptime. We further promise to upgrade our server capacity as and when necessary to provide a high level of functionality and reliability inline with the technical advice provided by our hosting service.

Linguaspectrum PLUS promises to maintain the integrity of all data created by teacher and student activity through the use of regular backups in addition to the daily backups provided by our hosting service.

Linguaspectrum PLUS promises to continually develop the bespoke systems used in the operation of this site to further enhance the usefulness and utility of the systems for both teachers and students alike. We listen to our teachers and students and make every effort to provide such improvements and additions to our services as are likely to be of benefit to all.

Linguaspectrum PLUS promises to maintain a completely transparent payment system by which teachers can easily see and track their earnings and payments. We further promise to make payments to our teachers immediately they become due. Funds are kept, escrow-style, in our PayPal account until payment at the end of each month. This protects both the buyer, the student, and the service provider, the teacher.
